Eligibility for Chapter 7 bankruptcy is determined primarily through the means test, which compares your income to the median income in your state for your household size. If your income is below the median, you likely qualify to file under Chapter 7. Additionally, you must not have filed a Chapter 7 bankruptcy in the last eight years or a Chapter 13 in the last six years.
Chapter 13 bankruptcy allows for the reorganization of most types of debt. Dischargeable debts include credit card debt, medical bills, personal loans, and more. However, certain obligations like student loans, alimony, child support, and certain tax debts typically cannot be discharged.
In both Chapter 7 and Chapter 13 bankruptcy, you can keep your house if you are current on your mortgage payments and continue to make these payments during and after the bankruptcy process. In Chapter 13, you may also catch up on overdue payments through your repayment plan.
The automatic stay is an immediate order upon filing for bankruptcy that halts creditors from all collection activities, including lawsuits, wage garnishments, and even telephone calls. It protects you from any creditor actions while your bankruptcy case is being processed.
Typically, a Chapter 7 bankruptcy case takes about four to six months from filing to discharge, depending on the court’s schedule and the complexity of your case.
Before filing for bankruptcy, you are required to complete a credit counseling session with an approved counseling agency. This session must occur within 180 days before filing and aims to provide financial education and evaluate possible alternatives to bankruptcy.
Filing for bankruptcy will have a negative impact on your credit score initially. Chapter 7 bankruptcy remains on your credit report for 10 years, while Chapter 13 remains for 7 years. However, the long-term effect can be positive as you reduce your debt-to-income ratio and begin to build a more stable financial foundation.
The meeting of creditors, also known as the 341 meeting, occurs about a month after you file for bankruptcy. During this meeting, the bankruptcy trustee and any creditors who choose to attend can ask questions about your bankruptcy forms and finances. You are required to attend and answer questions under oath. This meeting is typically brief and is intended to ensure that all information in your filing is accurate and that no fraud is involved.
